NY Tim BishopLast August I was extremely pleased when President Obama and Senate Majority Leader Reid pushed for a massive deficit reduction package of $4 trillion dollars. Unfortunately, partisan politics once again threw a wrench into us solving our deficit problem.

Now, because the so called “Super-committee” failed last November in its task to determine the specific places to cut spending, we are faced with budget sequestration (aka automatic across the board budget cuts.) These indiscrimant cuts could be devastating.

I was inspired and moved by Congressman Tim Bishop (D-NY) who, while pushing a “go big” $4 trillion deficit reduction target, is also exercising practical wisdom when it comes to dealing with the horrific consequences of budget sequestration’s across the board cuts.

“The cuts contained in the budget sequestration could damage our nation’s defense readiness, as well as hinder our ability to help the most vulnerable members of our society.  To be clear, these cuts are unacceptable. However, the proposal passed today by House Republicans (hr 5652) to remove the defense cuts and replace them with reductions to programs that directly affect middle class families and the poor is a misguided approach inconsistent with our nation’s values. Moving forward on a sustainable fiscal path will require shared sacrifice, and I cannot vote for one-sided legislation that places the burden of closing the budget gap disproportionately on low and middle income families.”

Protecting the country and our most vulnerable citizens is too important to be left to random cuts.

This standoff reminds me of the story of two sisters fighting over an orange. Exasperated they finally compromise by cutting the orange in half, each getting an equal share. One sister throws out her peel and eats her half of the orange. The other sister uses the skin of the orange for zest in a dinner recipe and throws out her half of the fruit. With a little bit of communication they could have both gotten 100% of what they wanted.

I don’t harbor any illusions that everyone can get exactly what they want here. Which is exactly why everyone should follow Congressman Bishop and at least do no harm.

A Key Part of the Debt Abuse Solution — “Walking a Mile in Their Moccasins” | Bartmann Blog

alex nathanThere’s a wise Indian proverb that says “Before you criticize someone, walk a mile in their moccasins.” After reading the inspiring story of Alex Nathan, it struck me that doing just that could go a long way to reforming many debt collectors abhorrent behaviors.

The reason I’ve always treated my clients (those CFS & CFS II collect delinquent debts from) with extreme dignity and respect is because I experienced first hand what it was like to be treated by debt collectors like I wasn’t worth spit. I’ve been through bankruptcy and I know, in excruciating detail, what it’s like trying to provide for a family when you have absolutely NO money.

The irony is that by treating people with kindness, you actually end up collecting more. This is now being proven publicly by people like Tom Gillespie and Alex Nathan.

What’s particularly interesting about Mr. Nathan is that he recently lost everything and found himself living in a Salvation Army homeless shelter in Sarasota, Florida. This experience allowed him to know, first hand, the difficulties people were having. His subsequent business became helping people get out of debt and was driven by his personal experience on the financial brink. Today he is making a lot of money by truly helping people. Honestly, what is better than that?

This got me to thinking:

What if EVERY debt collector would have had the ACTUAL experience of running out of money and being harassed by collection agents?

At the very least they’d learn two things:

  1. It’s miserable.
  2. Harassment isn’t terribly effective.

Those of you who have followed me for a while know that I’ve been working hard to get legislation passed in all 50 states that, in part, requires debt collectors to be licensed. Now I’m thinking that part of that licensing process should include a way to give collectors the down & out experience that I, Alex Nathan and countless others have had.

The question is, how do we do this?

I don’t have all the answers, so I’m asking for your help — how can we give prospective debt collectors the “experience” of being in debt and harassed by collectors, in a classroom or self-study type setting?

The Truth About “Nice Guy” Collectors | Bartmann Blog

Tom GillespieI believe that most debt collectors who harass, deceive and intimidate in order to collect debts, don’t do it because they enjoy inflicting pain on others. Rather, they do it because they believe that it is the best way for them to collect what they are rightfully due and provide for their employees and families.

The irony is that this hurtful approach actually yields them less financially.

I’ve long contended, and my companies financial returns have long proven, that treating people with dignity and respect yields far superior collection rates than industry averages.

Many have discounted our results, choosing to see us as an outlier, not the everyday rule.

Well today that is a bit harder since Baltimore, Maryland based Access Receivables has gone public with the results of their pilot “Nice People Collect More” program.

Access Receivables president, Tom Gillespie, is reporting collection rates 40% higher with their “nice guy” approach, compared to previous results.

Let that sink in, 40% more…by treating people properly.

Contrary to public perception, most debt collectors are business people, not masochists. I believe that as they see the results of the “nice guy” approach from more than one other company, the lightbulb will go off for them, like they were hit over the head with the “obvious stick.”

After all there’s not a greater force on earth than self-interest.

A Great Attorneys General Action Highlights The Fight for The Debt Collection Industry’s Soul | Bartmann Blog

darrell mcgrawOn Tuesday the ever vigilant West Virginia Attorney General, Darrell McGraw, announced a lawsuit against 7 UNLICENSED collection agencies for UNLAWFUL collection practices.

Now get this…his office was investigating direct complaints (not going on an unfounded witch-hunt) from West Virginia residents on a distressing array of debt collector misconduct including:

  • Repeated harassing phone calls
  • Impostors posing as law enforcement and judicial officials
  • Making false threats that non-payment will result in prosecution (criminally and civilly)
  • Collection of non-existing debts
  • Collection of debts that have already been paid

Now, before issuing the lawsuit AG McGraw actually issued subpoenas that asked the seven companies to produce records of their collection activities in West Virginia. You know what the companies did? They completely refused to comply. Doesn’t leave an Attorney General with many options but to litigate, does it?

Most “normal” people would applaud Attorney General McGraw and feel he was doing his job. Not so for the debt collection industry. Here was a comment left by a debt collector in response to the suit that illustrates a common point of view:

Again Darell McGraw will do anything to grab headlines. Worst A.G. in the country.”

Completely and utterly mind boggling.

What we’ve got here is a good old fashioned fight between “right” and self-interest. The distressing part is that I believe our industry is filled with many more who are interested in lining their own pockets at any means, than doing things the right way.

I’m just hoping that as A.G.’s like Mr. McGraw clean up our industry that can’t seem to police itself, I’ll be proven wrong.

CFPB – “We’ve Only Just Begun” | Bartmann Blog

CFPBReading through the Consumer Financial Protection Bureau’s (CFPB) first annual report to congress I could have sworn I heard Karen Carpenter singing in the background.

Though only in existence since July (and with Director Richard Cordray in place just since January) by almost any standard the CFPB is off to a fast start. From filing “friend of the court” Amicus Briefs, to their proposed rule to put the largest debt collectors under their direct regulatory microscope, Director Cordray and team have wasted no time.

This is good news, because there is no time to waste.

When you are heavily in debt you already feel like the walls are closing in around you. Mix in debt collectors who don’t fear the current slap on the wrist laws and low urgency enforcement and you have a volatile mix of desperation and hopelessness.

Fortunately the CFPB appears to really get this…and even better, to them it seems personal.

TOPEKA, Kan. — Only two weeks after Oklahoma lawmakers filed the Bartmann Ethical Debt Collection Act (SB 1430), the champion of the legislation moved north to the Kansas capital where he met with representatives of the Kansas Attorney General’s office. An industry insider and consumer advocate, Bill Bartmann is CEO of CFS II and the leader of a 50-state campaign to curb rampant consumer abuse by unregulated bill collectors.

“The Consumer Financial Protection Bureau and its director Richard Cordray are targeting this problem at a national level, but Kansas is a long way from Washington D.C. and consumers deserve local protection by their state’s authorities,” said Bartmann. “With 30 million Americans facing debt collectors, there’s a good chance you or someone you know has been harassed by these scumbags.”

AARP Oklahoma has endorsed the Oklahoma Senate Bill 1430, which comes following a wave of scandals that illustrate the need for reform in the debt collection and debt buyer industries. Across the country, state legislatures and state attorneys general are cracking down on collection agencies who trick consumers into paying debt that is past the statute of limitation and who submit fraudulent documentation to support lawsuits against consumers

In Kansas, the average debt per consumer was more than $15,000 in the second quarter of 2011, according to the Federal Reserve Bank of Kansas City. The explosive growth of debt buyers, companies that purchase charged-off debt from banks, has led to increasingly more aggressive strategies on the part of these companies. As consumers struggle to pay ever-mounting credit card bills during these hard times, complaints against collectors have soared.

Consumer complaints against debt collectors in 2010 reached 140,036, up 17 percent from a year earlier, according to the Federal Trade Commission. More than 50,000 people contacted the FTC to complain about harassment. Another 18,000 reported that a collector used obscene or otherwise abusive language and more than 4,000 consumers said a collector threatened them with violence.

“With about 30 million Americans facing late bills, the collection industry is being thrown into the national spotlight and not for good reasons,” said Bartmann. “Complaints against debt collectors are skyrocketing because the industry is overrun with scum bag collectors who harass consumers and practice illegal tactics to collect on late bills.”

On Wednesday in Topeka, Bartmann shared his proposal that serves as a model for Kansas and other states to reform debt buyer and debt collection laws and curb abusive and harassing practices. The 10-point model outlines critical reform ideas, including:

– Establish a program for state supervision and licensing of debt buyers and employees.

– Ban collection of “zombie debt” — debt that has passed the statute of limitation.

– Require debt buyers to provide proof of the debt before filing litigation.

– Require debt buyers to prove that consumers receive notice of litigation.

– Require that debt buyers provide proof of the debt to consumers upon demand.

– Authorize consumers to record phone calls from debt collectors.

– Authorize the Attorney General to impose fines and prosecute violators.

– Increase the penalties for debt buyers and debt collectors who violate the law.

– Discourage the filing of frivolous lawsuits by awarding costs to the prevailing party.

– Require that debt buyers, when transferring a debt, transfers all information about the consumer.

Bartmann launched the 50-state campaign, “Stop These Criminals,” nearly one year ago. The initiative is intended to reform the debt-collection industry and has proven successful, spurring the adoption of new regulatory law in Oklahoma. Since the legislation’s passage there in May, Bartmann has presented his recommendations for reducing debt collection abuse to more than two dozen state attorneys general, members of Congress, and federal consumer protection agencies.

“I built my career around the debt collection business and I know there is a right way and a wrong way to collect debt,” said Bartmann, a best-selling author who also wrote “Out of Control,” that exposed widespread criminal activity in the collections industry. “Unfortunately, our current regulatory system is not stopping criminal debt collectors from abusing helpless consumers.”

In the 1990s, Bartmann built CFS, the world’s largest debt collection agency, and became recognized as a national authority on fair debt collections practices. In fact, Inc. magazine credited CFS with “remaking one of the ugliest industries” due to the zero-abuse policy Bartmann demanded of his staff. His firm helped 4.5 million consumers resolve over $15 billion in credit card debt, without initiating a single lawsuit.

The Oklahoma Senate on Monday passed a bill designed to curb rampant consumer abuse by unregulated debt collectors. Senate Bill 1430, known as the Bartmann Ethical Debt Collection Act, passed the Senate 40 to 2 and now moves to the House.

“The overwhelming support of this bill sends a clear message to criminal debt collectors that they are not welcome in Oklahoma,” said Tulsa-based CFS II CEO Bill Bartmann, who helped initiate the bill authored by Republican Senator Gary Stanislawski.

“The Consumer Financial Protection Bureau and its director Richard Cordray are attacking debt collection abuse at a federal level, but Oklahomans deserve local protection from our state authorities,” said Bartmann.

AARP Oklahoma has endorsed SB 1430, which calls for state supervision and licensing of debt buyers and employees, among other requirements. Endorsed by both large and small debt buyer companies, SB 1430 is pro-business legislation designed to create a level playing field that encourages competition between smaller, more ethical state firms and larger out-of-state debt buyers who often cut corners, said Bartmann.

In addition to prohibiting the use of threatening or harassing language and techniques, the new measure should also help unclog Oklahoma’s court system by reducing the number of knee-jerk law suits filed by collection attorneys against consumers who have not yet had a reasonable opportunity to pay legitimate bills.

The legislation comes following a wave of scandals that illustrate the need for reform in the debt collection and debt buyer industries. Nice Guys Don’t Always Finish Last – The Americollect Story | Bartmann Blog

CEO of Americollect in Wisconsin wins award

I was very pleased to learn that this past week a debt collector, Americollect of Manitowic, Wisc., won the Chamber of Commerce award for Large Business of the Year award.

Rarely do debt collectors get praised for anything, so this is notable right out of the gate. Upon closer examination, Americollect should not only be praised for running a successful business, but for running it in the right, “nice,” way.

Here’s what jumped out to me when I learned of Americollect and their CEO, Kenlyn Gretz:

  • They call the people they are collecting from “customers.”
  • They preach a win-win collection model.
  • The company and employees donated to 52 non-profits last year.
  • They have a A+ rating from the Better Business Bureau.
  • They CEO attributes their growth the their quality personnel and corporate culture.

Americollect has been in business since 1964. This is obviously no accident. When you run a debt collection operation ethically, it can be both a profitable and honorable profession. Honorable because one of the “Wins” in Win-Win means that the customer gets a helping hand out of debt. This is a great thing for all concerned…including society at large.

What If… | Bartmann Blog

What if…. the neediest among us were treated with dignity and respect. What if debt collectors got better results from treating people with dignity and respect, than harassing, intimidating and insulting. What if debt collectors had to be licensed, like other professionals. What if there were financial penalties when debt collectors behaved improperly?

What if… consumers were allowed to record debt collector calls? What if those recordings were able to be used as evidence in a court of law? What if banks were financially liable for the misdeeds of the collectors they selected to work with?

What if… having complete and accurate records increased the amount a bank could sell a delinquent loan for? What if Congress passed a law making it illegal for debt collectors to call a consumer more than once in a 24 hour period? What if misdeeds are more financially rewording to debt collectors than behaving legally and humanely?
